1. Purpose
The purpose of this Policy is to establish the terms and conditions governing the provision of skincare and aesthetic treatments by 25PSKYN Studios.
This Policy is designed to:
- ensure transparency in the provision of treatments and treatment plans;
- clearly explain the rights and responsibilities of both the Clinic and its clients;
- outline the terms applicable to consultations, treatment plans, payments, refunds, cancellations and included products;
- explain how refunds are calculated where applicable;
- protect both the Clinic and its clients by setting clear contractual expectations before treatment commences; and
- ensure compliance with applicable laws and professional standards, including the Nigeria Data Protection Act, 2023 (NDPA).
This Policy forms part of every treatment agreement entered into between 25PSKYN Studios and its clients.
By booking a consultation, purchasing a treatment plan, paying for an individual treatment session, or signing the Client Declaration contained in this Policy, the client acknowledges that they have read, understood and agreed to be bound by the provisions of this Policy.
2. Definitions
For the purpose of this Policy, the following terms shall have the meanings assigned to them below unless the context otherwise requires:
- "Clinic"
- means 25PSKYN Studios, its directors, employees, practitioners, consultants, affiliates and authorised representatives.
- "Client"
- means any individual receiving or intending to receive consultation, skincare, aesthetic or related services from the Clinic.
- "Consultation"
- means the professional assessment conducted by a qualified practitioner before treatment, including medical history review, skin assessment, treatment planning and recommendations.
- "Treatment"
- means any skincare, aesthetic, cosmetic or wellness procedure performed by the Clinic.
- "Treatment Session"
- means one scheduled treatment appointment.
- "Treatment Plan"
- means a discounted package consisting of multiple treatment sessions together with other benefits offered by the Clinic.
- "Included Products"
- means skincare or treatment-support products supplied as part of a Treatment Plan. These products form part of the overall package value and are not promotional gifts or complimentary items.
- "Package Price"
- means the discounted amount payable for a Treatment Plan.
- "Standard Treatment Rate"
- means the Clinic's prevailing price for an individual treatment session purchased outside a Treatment Plan.
- "Refund"
- means any amount approved by the Clinic to be returned to a client in accordance with this Policy.
- "VAT"
- means Value Added Tax or any similar statutory tax imposed under applicable Nigerian law.
3. Scope
This Policy applies to all clients of 25PSKYN Studios who:
- attend consultations;
- purchase Treatment Plans;
- receive individual treatment sessions;
- purchase products as part of a Treatment Plan;
- make payments for clinic services;
- request cancellations;
- request refunds;
- receive maintenance treatments; or
- otherwise engage the services of the Clinic.
This Policy applies irrespective of whether payment is made:
- in full;
- by instalments;
- by bank transfer;
- through a payment gateway;
- by debit or credit card;
- through a Point-of-Sale (POS) terminal; or
- through any other payment method approved by the Clinic.
Where a client purchases a Treatment Plan through a promotion, discount campaign or special offer, this Policy shall continue to apply unless expressly stated otherwise in writing by the Clinic.
4. Treatment Options
25PSKYN Studios offers clients two options for receiving treatment.
4.1 Individual Treatment Sessions
Clients may elect to receive treatment on a session-by-session basis.
Where this option is selected:
- each treatment session shall be charged at the applicable Standard Treatment Rate;
- payment shall be made before each treatment session unless otherwise agreed by the Clinic;
- individual treatment pricing shall not include the promotional discounts available under Treatment Plans;
- skincare products recommended during treatment shall be purchased separately unless expressly included by the Clinic.
Clients who choose this option retain flexibility to schedule treatments as required but will not enjoy the financial benefits associated with Treatment Plans.
4.2 Treatment Plans
Clients may instead elect to purchase one of the Clinic's structured Treatment Plans.
Treatment Plans are designed for clients requiring multiple treatment sessions over a defined period to achieve optimal clinical outcomes.
Each Treatment Plan includes:
- a predetermined number of treatment sessions;
- clinical monitoring;
- periodic treatment reviews where applicable;
- professional treatment planning;
- administrative support;
- follow-up care where applicable; and
- Included Products allocated to the selected Treatment Plan.
Treatment Plans are offered at a discounted package price in comparison to purchasing each treatment session individually.
The discounted package price reflects the client's commitment to completing the recommended treatment programme.
4.3 Selection of Treatment Plans
Following consultation, the Clinic shall recommend the Treatment Plan considered most appropriate for the client's skin condition and treatment objectives.
The client remains free to:
- accept the recommended Treatment Plan;
- choose an alternative Treatment Plan where clinically suitable; or
- receive treatment on an individual session basis.
The Clinic reserves the right to decline any treatment option where, in its professional opinion, such treatment is not clinically appropriate or safe.
4.4 No Guarantee of Eligibility
A recommendation that a client is suitable for a Treatment Plan does not guarantee that treatment will commence immediately or that the client will ultimately be eligible to receive treatment.
The Clinic reserves the right to postpone, modify or decline treatment where, in its professional opinion, it is necessary or appropriate to do so.
Treatment may be postponed, suspended or declined where:
- further medical information, investigations or medical clearance is required;
- contraindications or other clinical concerns are identified;
- the client fails or refuses to disclose relevant medical history or other information necessary for safe treatment;
- the client provides false, incomplete or misleading information regarding their health or medical condition;
- payment obligations remain outstanding or payment has not been successfully processed;
- the client refuses to provide the required informed consent for treatment;
- the client refuses to permit clinical photographs to be taken for documentation, treatment monitoring and medical record purposes, where such photographs are required under the Clinic's treatment protocol;
- the client fails to comply with the Clinic's policies or treatment instructions;
- the client is under the influence of alcohol, recreational drugs or any substance that may impair their ability to provide informed consent or safely undergo treatment;
- the client behaves in a manner that is abusive, threatening, disruptive or otherwise inappropriate towards the Clinic's staff or other clients; or
- the treating practitioner reasonably considers that proceeding with treatment would be unsafe, clinically inappropriate or inconsistent with accepted professional standards.
Where treatment is postponed or declined under this clause, the Clinic shall, where reasonably practicable, explain the reasons for its decision and may recommend alternative treatment options or request that the client obtain further medical assessment before treatment can proceed.
Any refund arising from a decision to postpone, suspend or decline treatment shall be determined strictly in accordance with the Refund Policy contained in this document.
5. Treatment Plans and Pricing
5.1 Treatment Plans
25PSKYN Studios offers structured Treatment Plans designed to provide clients with a comprehensive and cost-effective approach to achieving their skincare and aesthetic goals.
Treatment Plans are carefully curated based on the client's skin condition, treatment objectives, and the professional recommendation of the Clinic. They are intended to encourage consistency of care and improve treatment outcomes through a planned course of treatment rather than isolated procedures.
The Clinic reserves the right to introduce, modify or discontinue Treatment Plans at any time. Such changes shall not affect Treatment Plans already purchased unless agreed otherwise with the client.
5.2 Discounted Package Pricing
Treatment Plans are offered at significantly discounted package prices when compared with purchasing each treatment session individually.
The discounted package price reflects:
- the client's commitment to completing the recommended course of treatment;
- the Clinic's allocation of treatment resources over the duration of the Treatment Plan;
- professional treatment planning and monitoring;
- scheduled treatment reviews;
- administrative support;
- clinical oversight throughout the treatment period; and
- Included Products supplied as part of the Treatment Plan.
The package price is therefore a promotional bundled price and shall not be interpreted as the cumulative value of individual treatment sessions.
Clients acknowledge that the discounted package price is offered on the understanding that the Treatment Plan will be completed in accordance with the recommended treatment schedule.
5.3 Standard Treatment Rates
For refund calculations and other purposes under this Policy, each treatment session shall have a corresponding Standard Treatment Rate, being the amount ordinarily charged where the treatment is purchased individually.
The Standard Treatment Rate shall be determined by the Clinic and may be revised from time to time.
Any refund calculation shall be based on the applicable Standard Treatment Rate in force at the time the Treatment Plan was purchased unless otherwise determined by the Clinic.
5.4 Individual Treatment Sessions
Clients who do not wish to purchase a Treatment Plan may elect to receive treatment on a per-session basis.
Individual sessions shall be charged at the prevailing Standard Treatment Rate and shall not include:
- package discounts;
- treatment plan incentives;
- Included Products;
- complimentary reviews (unless expressly stated); or
- any other benefits reserved for Treatment Plans.
5.5 Treatment Recommendations
Treatment recommendations made by the Clinic are based on professional assessment and clinical judgment.
Clients remain free to decide whether to:
- purchase the recommended Treatment Plan;
- receive treatment on a per-session basis; or
- defer treatment entirely.
The Clinic reserves the right to refuse any requested treatment where, in its professional opinion, the requested treatment is not clinically appropriate or safe.
6. Consultation Policy
6.1 Mandatory Consultation
Except where otherwise determined by the Clinic, every client shall undergo an initial consultation before any treatment is commenced.
The consultation is an essential part of the treatment process and enables the Clinic to determine whether treatment is appropriate for the client.
The consultation may include:
- assessment of the client's skin condition;
- review of medical history;
- discussion of previous treatments;
- review of allergies and medications;
- identification of contraindications;
- skin analysis;
- treatment recommendations;
- discussion of expected outcomes;
- discussion of treatment risks and limitations;
- preparation of a personalised treatment plan;
- recommendation of appropriate skincare products.
6.2 Consultation Fee
A consultation fee shall be payable at the rate prescribed by the Clinic.
The consultation fee is charged for the professional time, expertise and assessment provided by the practitioner.
The consultation fee is separate from:
- treatment costs;
- product purchases;
- Treatment Plan fees; and
- review appointments.
6.3 Non-Refundable Consultation Fee
Once the consultation has been completed, the consultation service shall be deemed fully rendered.
Accordingly:
- the consultation fee is non-refundable;
- the consultation fee shall not be credited towards future services unless expressly approved by the Clinic;
- where a refund of a Treatment Plan is approved, the consultation fee shall be deducted from the refundable amount.
This applies irrespective of whether treatment has commenced.
6.4 Failure to Attend Consultation
Clients who fail to attend a scheduled consultation without giving at least twenty-four (24) hours' notice may forfeit the consultation fee.
Any rescheduling shall be subject to availability.
7. Included Products
7.1 Included Products
Certain Treatment Plans include professionally selected skincare products intended to complement the client's treatment programme and improve treatment outcomes.
These products are referred to throughout this Policy as Included Products.
Included Products form part of the commercial value of the Treatment Plan and are not free gifts, promotional giveaways or complimentary items.
7.2 Purpose of Included Products
Included Products are prescribed by the Clinic to:
- prepare the skin before treatment;
- support healing after treatment;
- improve treatment outcomes;
- maintain treatment results;
- reduce the risk of complications;
- provide an effective home-care routine.
Clients are encouraged to use Included Products strictly in accordance with the instructions provided by the Clinic.
7.3 Ownership of Included Products
Ownership of Included Products passes to the client upon supply.
Once products have been dispensed, supplied or collected:
- they cannot be returned for hygiene and safety reasons;
- they cannot be exchanged unless defective;
- they cannot be credited towards other treatments.
7.4 Refunds and Included Products
Where a client requests a refund before completing a Treatment Plan, the value of Included Products already supplied shall be deducted from the refundable amount.
Where appropriate, the Clinic may apportion the value of Included Products in accordance with the unused portion of the Treatment Plan.
Clients acknowledge that Included Products form part of the Treatment Plan purchased and are not supplied independently of that Treatment Plan.
8. Treatment Plan Duration and Validity
Each Treatment Plan has a recommended completion period based on the clinical requirements of the treatment programme.
Clients are expected to complete their Treatment Plan within the duration specified for their selected package.
Failure to complete the Treatment Plan within the recommended timeframe may affect treatment outcomes.
Treatment Plans shall remain valid only for the period communicated by the Clinic at the time of purchase unless extended in writing.
Extensions may be granted where:
- treatment has been postponed for medical reasons;
- the Clinic has rescheduled appointments;
- exceptional circumstances exist;
- the Clinic considers an extension appropriate.
Unused sessions remaining after the expiry of the Treatment Plan may be forfeited unless otherwise approved by the Clinic.
9. Appointment Booking
Appointments shall be scheduled by mutual agreement between the Clinic and the client.
Clients are encouraged to book appointments in advance to ensure availability.
Appointment dates and times are subject to practitioner availability and operational requirements.
The Clinic reserves the right to reschedule appointments where necessary due to operational, medical or emergency circumstances.
Reasonable notice shall be provided wherever practicable.
9.2 Assignment of Aestheticians
9.2.1 Allocation of Aestheticians
To ensure the efficient delivery of services and continuity of care, clients shall be assigned an Aesthetician by 25PSKYN Studios based on operational requirements, appointment availability, scheduling and the clinical needs of the client.
While the Clinic may, where reasonably practicable, take into consideration a client's preference for a particular Aesthetician, the assignment of an Aesthetician remains at the sole discretion of the Clinic and no client is guaranteed treatment by any specific Aesthetician.
9.2.2 Change of Aesthetician
The Clinic reserves the right to assign or reassign a client to another qualified Aesthetician at any time where it is necessary or appropriate, including but not limited to where:
- the assigned Aesthetician is unavailable due to leave, illness, training or other operational reasons;
- scheduling adjustments are required;
- the Clinic considers that another Aesthetician is better suited to continue the client's treatment;
- it is necessary to ensure continuity of care or minimise delays to treatment; or
- any other operational or clinical reason exists.
Such reassignment shall not constitute a change to the client's Treatment Plan or affect the standard of care to be provided.
9.2.3 Standard of Care
All Aestheticians engaged by 25PSKYN Studios are appropriately trained, qualified and competent to perform the treatments offered by the Clinic.
Each Aesthetician is required to adhere to the Clinic's treatment protocols, clinical guidelines, quality assurance procedures and professional standards.
Accordingly, clients can expect a consistent standard of professional care regardless of the Aesthetician assigned to provide their treatment.
9.2.4 Client Preferences
The Clinic values client comfort and will make reasonable efforts to accommodate requests for a particular Aesthetician where operationally feasible.
However, the Clinic does not guarantee the continued availability of any specific Aesthetician, and a client's preference for a particular practitioner shall not entitle the client to postpone treatment, demand a refund, or decline treatment where another suitably qualified Aesthetician has been assigned by the Clinic.
Where a client elects not to proceed with treatment solely because a different qualified Aesthetician has been assigned, the Clinic's Cancellation, Rescheduling and Refund Policy shall apply.
10. Late Arrivals
Clients are expected to arrive punctually for all appointments.
Clients arriving more than fifteen (15) minutes late may:
- have their appointment shortened;
- be required to reschedule;
- forfeit the appointment where sufficient treatment time is no longer available.
Where an appointment cannot proceed due to a client's late arrival, the Clinic reserves the right to treat the appointment as a missed appointment for the purposes of this Policy.
11. Cancellation, Rescheduling and Missed Appointments
Clients who wish to cancel or reschedule a scheduled appointment must provide the Clinic with not less than twenty-four (24) hours' prior notice.
11.1 Rescheduling of Appointments
To provide flexibility while ensuring efficient scheduling of appointments, each client is entitled to one (1) complimentary appointment rescheduling per calendar month, subject to availability.
Where a client requests to reschedule an appointment more than once within the same calendar month, a rescheduling fee, at the prevailing rate determined by the Clinic, shall be payable before the new appointment is confirmed.
The applicable rescheduling fee shall be communicated to the client at the time the rescheduling request is made.
Rescheduling requests remain subject to appointment availability and the Clinic does not guarantee that the client's preferred date or time will be available.
11.2 Late Cancellations and Failure to Attend
Where a client fails to provide the required twenty-four (24) hours' notice before cancelling or rescheduling an appointment, the Clinic reserves the right to apply one or more of the following measures:
- treat the appointment as utilised;
- deduct the relevant treatment session from the client's Treatment Plan;
- require payment of the applicable rescheduling fee;
- forfeit any booking deposit paid; or
- require payment of any outstanding fees before further appointments are scheduled.
The Clinic may, at its sole discretion, waive any applicable fee or penalty where exceptional circumstances are demonstrated.
11.3 Repeated Cancellations or Non-Attendance
Repeated cancellations, frequent requests for rescheduling, missed appointments or persistent non-attendance may adversely affect the client's treatment outcomes and the Clinic's scheduling of appointments.
Accordingly, the Clinic reserves the right to:
- suspend the client's Treatment Plan;
- refuse future appointment bookings until outstanding issues have been resolved;
- require prepayment for future appointments;
- terminate the Treatment Plan in accordance with this Policy; or
- apply any other reasonable administrative measures considered necessary.
Where a Treatment Plan is terminated under this clause, any refund shall be calculated strictly in accordance with the Refund Policy contained in this Policy.
12. Payment Policy
12.1 Payment Requirement
All consultations, treatments, Treatment Plans, products and other services provided by 25PSKYN Studios shall be paid for in accordance with the payment terms communicated by the Clinic.
Unless otherwise approved in writing by the Clinic, payment shall be made before treatment is administered.
The Clinic reserves the right to refuse, postpone or discontinue treatment where payment has not been received or where a client has failed to comply with agreed payment terms.
12.2 Accepted Payment Methods
The Clinic may accept payment through any of the following channels:
- Bank Transfer;
- Debit Card;
- Credit Card;
- Point-of-Sale (POS) Terminal;
- Electronic Payment Platforms;
- Payment Links;
- Mobile Payment Applications; and
- Any other payment method approved by the Clinic.
The Clinic reserves the right to introduce or discontinue any payment method without prior notice.
12.3 Instalment Payments
Where the Clinic permits payment by instalments, the Client agrees to pay all instalments on or before their due dates.
Failure to make payment when due may result in any or all of the following:
- suspension of future treatment appointments;
- suspension of the Treatment Plan;
- withholding of Included Products;
- refusal to schedule additional appointments until payment is regularised;
- cancellation of the Treatment Plan where the default continues.
Any outstanding balance shall remain payable notwithstanding suspension or cancellation.
12.4 Price Changes
The Clinic reserves the right to revise the prices of consultations, treatments, products and Treatment Plans at any time.
Price revisions shall not affect Treatment Plans that have already been purchased and paid for in full unless otherwise agreed by the parties.
Where payment is being made by instalments, the agreed Treatment Plan price shall remain applicable provided instalments are paid in accordance with the agreed payment schedule.
12.5 Promotional Pricing
Treatment Plans are offered at promotional and discounted prices.
The promotional pricing reflects the client's commitment to completing the recommended treatment programme.
Accordingly, clients acknowledge that they are receiving substantial financial benefits through Treatment Plans compared with purchasing each treatment individually.
The promotional nature of Treatment Plans shall be taken into account when determining any refund.
13. Payment Authorisation
By paying for any consultation, treatment, Treatment Plan or product, the client expressly authorises the Clinic to:
- process payments for consultations, treatment sessions, products and related services;
- allocate payments towards the client's outstanding obligations;
- process approved refunds in accordance with this Policy;
- deduct consultation fees, Included Product costs, VAT and any other applicable deductions permitted under this Policy;
- refund monies through the original payment method wherever reasonably practicable or through any other method determined by the Clinic.
The client further acknowledges that refunds may require processing time depending on the payment provider, acquiring bank or financial institution.
The Clinic shall not be liable for delays caused by third-party payment processors.
14. Refund Policy
14.1 General Principle
25PSKYN Studios is committed to providing high-quality skincare and aesthetic services while ensuring fairness and transparency in its refund process.
Treatment Plans are offered at substantially discounted prices and include professional services, treatment planning, Included Products and clinical support.
Accordingly, refunds are not automatic and shall only be considered in accordance with this Policy.
The existence of a Treatment Plan does not create an automatic right to a refund.
Any approved refund will be processed between 7 to 14 working days.
14.2 Refund Requests
Clients wishing to request a refund shall submit a written request to the Clinic stating:
- the reason for the request;
- the Treatment Plan purchased;
- the number of treatment sessions attended;
- any other information reasonably requested by the Clinic.
The Clinic shall review each request and communicate its decision within a reasonable period.
14.3 Approval of Refunds
Refunds shall only be processed where approved by the Clinic.
In determining whether a refund should be approved, the Clinic may consider:
- the number of treatment sessions already received;
- the products already supplied;
- professional services already rendered;
- treatment records;
- payment history;
- the reasons for the request; and
- any other relevant circumstances.
Approval of one refund request shall not create a precedent for future refund requests.
14.4 What Refunds Cover
Where approved, refunds relate only to the value of unused treatment sessions, subject to the deductions provided under this Policy.
Refunds do not include reimbursement for:
- consultation services;
- Included Products;
- products already dispensed;
- completed treatment sessions;
- add-on procedures;
- enhancement treatments;
- medications;
- consumables;
- review appointments already conducted;
- booking fees;
- administrative costs where applicable;
- promotional discounts enjoyed by the client.
14.5 Full Refund Requests
Where a client requests a refund of the entire amount paid, whether:
- before any treatment session has been administered; or
- after one or more treatment sessions have been administered,
the refund shall nevertheless be calculated strictly in accordance with this Policy.
For the avoidance of doubt, the following deductions shall continue to apply where applicable:
- Consultation Fees;
- Included Product costs;
- VAT or other statutory taxes already remitted;
- value of treatment sessions already received;
- any other deductions expressly permitted under this Policy.
A request for a full refund shall not entitle the client to recover amounts relating to professional services already rendered, products already supplied or statutory taxes already remitted.
14.6 Circumstances Where Refunds May Not Be Granted
Without prejudice to the Clinic's discretion, refunds may be refused where:
- the Treatment Plan has been fully utilised;
- treatment has been successfully completed;
- products have been fully supplied and substantially consumed;
- the client discontinues treatment contrary to professional advice;
- dissatisfaction relates solely to unrealistic expectations rather than any deficiency in the services provided;
- the client has failed to comply with treatment instructions;
- the client has failed to disclose relevant medical information affecting treatment.
Nothing in this section shall exclude any rights the client may have under applicable law.
15. Refund Calculation Methodology
15.1 General Rule
Where a refund is approved, it shall be calculated using the methodology contained in this Policy.
The refund methodology has been developed to ensure fairness to both the client and the Clinic by recognising:
- the discounted nature of Treatment Plans;
- services already rendered;
- Included Products supplied;
- statutory taxes already remitted; and
- professional consultation services already provided.
Refunds shall never be calculated by simply dividing the Treatment Plan price by the number of sessions purchased.
15.2 Step One: Determine the Value of Sessions Already Used
The Clinic shall first determine the value of all treatment sessions already received by the client.
Each completed treatment session shall be valued at the applicable Standard Treatment Rate rather than the discounted Treatment Plan rate.
The total value of completed sessions shall then be deducted from the amount paid by the client.
The resulting balance represents the value attributable to unused treatment sessions.
15.3 Step Two: Determine the Unused Session Value
The unused session value shall be calculated as follows:

The resulting amount shall form the starting point for the refund calculation.
15.4 Step Three: Deduction of VAT
Where Value Added Tax (VAT) has already been charged and remitted to the appropriate tax authority, the VAT component shall be deducted before calculating the final refund.
The client acknowledges that VAT constitutes a statutory tax collected on behalf of the Government and does not represent income retained by the Clinic.
15.5 Step Four: Deduction of Included Products
Treatment Plans include skincare products forming part of the overall package value.
Where Included Products have already been supplied to the client, the Clinic shall deduct:
- the actual cost of the Included Products; or
- an apportioned value of those products,
depending on the circumstances of the Treatment Plan and the stage at which the refund request is made.
The method adopted shall be that which most fairly reflects the remaining value of the Treatment Plan.
15.6 Step Five: Deduction of Consultation Fee
Where the consultation has already taken place, the Consultation Fee shall be deducted in full.
The client acknowledges that the consultation constitutes a professional service that has already been rendered and is therefore non-refundable.
15.7 Step Six: Final Refund
After applying all deductions required under this Policy, the remaining balance shall constitute the refund payable to the client.
Where the deductions equal or exceed the unused session value, no refund shall be payable.
15.8 Clinic Determination of Refund
Refund calculations shall be carried out by the Clinic in accordance with this Policy.
Upon request, the Clinic shall provide the client with a written breakdown of the refund calculation.
Unless there is a manifest mathematical or clerical error, the Clinic's calculation of the refund shall be final, conclusive and binding on both the Clinic and the client.
Nothing in this clause shall prejudice any rights available to either party under applicable law.
16. Illustrative Refund Calculation
The following example is provided solely to explain the refund methodology adopted by the Clinic.
The figures below are illustrative only and do not constitute a guarantee of the refund payable in any particular case.

17. Client Responsibilities
17.1 Duty to Provide Accurate Information
Clients are responsible for providing complete, accurate and up-to-date information concerning their health, medical history and any other information that may affect their suitability for treatment.
The client shall immediately notify the Clinic if there is any change to their medical condition, medications, allergies or other relevant circumstances during the course of their treatment.
Failure to disclose relevant information may:
- affect treatment outcomes;
- increase the risk of complications;
- require modification or discontinuation of treatment; and
- affect the client's eligibility for a refund where such non-disclosure has materially impacted the treatment.
17.2 Compliance with Treatment Instructions
Clients agree to comply with all pre-treatment and post-treatment instructions provided by the Clinic.
This includes, where applicable:
- using prescribed skincare products as directed;
- attending scheduled review appointments;
- avoiding activities or products that may interfere with treatment outcomes;
- reporting any adverse reactions promptly; and
- following all home-care recommendations.
The Clinic shall not be responsible for treatment outcomes adversely affected by a client's failure to follow professional advice.
17.3 Attendance at Appointments
Clients are responsible for attending appointments at the dates and times agreed with the Clinic.
Failure to attend scheduled appointments may affect treatment outcomes and may result in missed appointment charges or forfeiture of treatment sessions in accordance with this Policy.
18. Medical Assessment and Contraindications
The Clinic reserves the right to postpone, modify or decline any treatment where it considers that proceeding with treatment may not be in the client's best medical interests.
Treatment may be delayed or declined where:
- the client has an active skin infection;
- the client is pregnant or breastfeeding (where applicable);
- contraindications exist;
- the client has failed to disclose relevant medical information;
- the client is taking medication that affects treatment suitability;
- the practitioner reasonably believes treatment may present an unacceptable risk.
The Clinic may require additional medical clearance before treatment proceeds.
No refund shall arise solely because treatment is postponed for medical or safety reasons. Where treatment cannot proceed permanently, any refund shall be determined in accordance with this Policy.
19. Results Disclaimer
The Clinic uses professionally accepted procedures, equipment and products to maximise treatment outcomes.
However, aesthetic and skincare treatments involve biological processes that vary significantly between individuals.
Accordingly, treatment outcomes depend on several factors, including:
- the client's skin type;
- age;
- genetics;
- hormonal influences;
- medical conditions;
- lifestyle;
- sun exposure;
- adherence to treatment recommendations;
- consistency in attending appointments; and
- compliance with home-care instructions.
For this reason:
- no specific outcome can be guaranteed;
- no promise is made that a particular result will be achieved;
- photographs of previous clients or promotional materials are illustrative only and should not be interpreted as guarantees of identical results.
The client acknowledges that treatment outcomes may differ from person to person.
20. Limitation of Liability
To the fullest extent permitted by applicable law, 25PSKYN Studios shall not be liable for:
- dissatisfaction arising solely from subjective expectations of treatment outcomes;
- complications resulting from undisclosed medical conditions;
- complications arising from failure to follow treatment advice;
- allergic reactions not reasonably foreseeable;
- delays caused by third-party suppliers or payment providers;
- interruptions resulting from circumstances beyond the Clinic's reasonable control.
Nothing in this Policy shall exclude liability for fraud, gross negligence, wilful misconduct or any liability that cannot lawfully be excluded under applicable law.
21. Data Collection, Privacy and Processing
21.1 Collection of Personal Information
To provide safe, effective and lawful treatment services, the Clinic collects and processes personal information relating to its clients.
Such information may include:
- full name;
- residential address;
- telephone number;
- email address;
- date of birth;
- emergency contact details;
- medical history;
- allergies;
- medications;
- previous procedures;
- skin assessments;
- treatment records;
- photographs;
- payment information;
- any other information reasonably required for treatment.
21.2 Purpose of Processing
The Clinic processes personal information for purposes including:
- verifying client identity;
- scheduling appointments;
- assessing treatment suitability;
- maintaining medical records;
- monitoring treatment progress;
- prescribing products;
- communicating with clients;
- processing payments;
- processing refunds;
- regulatory compliance;
- internal audits;
- quality assurance;
- responding to complaints;
- defending legal claims;
- any other lawful purpose connected with the provision of skincare and aesthetic services.
21.3 Client Consent
By signing this Policy or proceeding with treatment, the client expressly consents to the collection, storage, use and processing of their personal information for the purposes stated above.
The client acknowledges that the Clinic may retain treatment records for the period required under applicable law or professional practice standards.
21.4 Data Protection
25PSKYN Studios shall process all personal information in accordance with the Nigeria Data Protection Act, 2023, and any other applicable data protection legislation.
The Clinic shall implement appropriate technical and organisational security measures designed to protect personal information from unauthorised access, alteration, disclosure or destruction.
21.5 Sharing of Information
The Clinic shall not disclose a client's personal information to third parties except:
- where required by law;
- where necessary for treatment;
- where required by regulatory authorities;
- where necessary to process payments;
- where the client has provided consent.
21.6 Client Rights
Subject to applicable law, clients may request:
- access to their personal information;
- correction of inaccurate information;
- withdrawal of consent where legally permissible;
- deletion of personal information where retention is no longer required by law.
Such requests shall be made in writing to the Clinic.
22. Clinical Photography and Image Consent
22.1 Clinical Photography
To ensure accurate diagnosis, effective treatment planning and proper monitoring of treatment outcomes, 25PSKYN Studios routinely takes clinical photographs of clients before, during and after treatment.
Clinical photographs form part of the client's confidential medical and treatment records and are considered an essential aspect of the Clinic's standard of care. The Clinic shall not publish or use identifiable photographs for marketing, advertising, promotional campaigns, social media or publications without obtaining the client's separate written consent.
Photographs may be taken at every consultation and treatment visit where the treating practitioner considers it clinically appropriate.
22.2 Purpose of Clinical Photography
Clinical photographs are taken solely for legitimate clinical and operational purposes, including:
- documenting the client's condition before treatment;
- monitoring treatment progress;
- evaluating treatment effectiveness;
- comparing treatment outcomes over time;
- assisting practitioners in reviewing and adjusting treatment plans;
- maintaining accurate clinical records;
- supporting internal clinical discussions and quality assurance processes.
These photographs are intended solely for internal clinical use unless the client provides separate written consent for another purpose.
22.3 Confidentiality of Clinical Photographs
All clinical photographs shall be treated as confidential medical records and stored securely in accordance with the Nigeria Data Protection Act, 2023, and the Clinic's data protection policies.
Access to clinical photographs shall be restricted to authorised personnel who require such access for legitimate clinical or administrative purposes.
22.4 Use of Photographs for Marketing or Publicity
The Clinic shall not use any client's photographs for:
- advertising;
- marketing campaigns;
- social media;
- websites;
- brochures;
- educational publications;
- promotional materials; or
- any other public-facing purpose,
unless the client has first provided separate, voluntary, written and signed consent specifically authorising such use.
Refusal to consent to marketing use of photographs shall not affect the client's entitlement to treatment.
22.5 Refusal of Clinical Photography
Clinical photography is an essential component of the Clinic's treatment protocol and record-keeping process.
Accordingly, where a client refuses to permit photographs to be taken for clinical documentation, monitoring and treatment purposes, the Clinic reserves the right to refuse or discontinue treatment where, in its professional judgment, the absence of photographic documentation would compromise:
- accurate diagnosis;
- treatment planning;
- monitoring of progress;
- patient safety;
- continuity of care; or
- the Clinic's ability to maintain complete and accurate medical records.
Any refusal of treatment under this clause shall not constitute a breach of this Policy by the Clinic.
23. Consent to Treatment
Before treatment commences, the client confirms that:
- the proposed treatment has been explained;
- expected benefits have been discussed;
- possible risks and complications have been explained;
- alternative treatment options have been discussed where appropriate;
- all questions have been answered satisfactorily;
- they understand that results cannot be guaranteed;
- they voluntarily consent to treatment.
The client further confirms that all medical information provided is true and complete to the best of their knowledge.
24. Medical Emergencies and Adverse Reactions
24.1 Reporting Adverse Reactions
While every reasonable effort is made to provide safe and appropriate treatment, aesthetic and skincare procedures may carry inherent risks, including unexpected side effects or adverse reactions.
Clients are required to notify the Clinic immediately if they experience any unexpected or concerning symptoms following treatment, including but not limited to:
- excessive pain;
- persistent redness or swelling beyond the expected recovery period;
- severe irritation;
- blistering;
- infection;
- allergic reactions;
- bleeding;
- skin discoloration;
- scarring; or
- any other unusual reaction.
Prompt reporting enables the Clinic to provide appropriate advice, follow-up care or referral where necessary.
24.2 Emergency Medical Care
Where the Clinic reasonably believes that a client requires urgent medical attention, the Clinic may recommend that the client immediately seek treatment at an appropriate hospital or healthcare facility.
The Clinic may also contact the client's emergency contact person where necessary to protect the client's health or safety.
Nothing in this Policy obligates the Clinic to provide emergency medical treatment beyond its professional competence or regulatory scope.
24.3 Costs of Emergency Treatment
Where emergency medical treatment is required from another healthcare provider or medical facility, all costs associated with such treatment shall be the responsibility of the client unless otherwise provided by applicable law or covered by insurance.
The Clinic shall not be responsible for fees charged by third-party hospitals, specialists, pharmacies or emergency service providers.
24.4 Follow-Up Care
Following any reported adverse reaction, the Clinic may:
- request the client to attend an immediate review appointment;
- modify the treatment plan;
- suspend further treatment;
- recommend additional products;
- recommend referral to another healthcare professional where appropriate.
The client agrees to cooperate fully with any reasonable follow-up recommendations.
25. Right to Refuse or Discontinue Treatment
25PSKYN Studios reserves the right to refuse, postpone or discontinue treatment where it reasonably considers that:
- treatment would not be clinically appropriate;
- treatment may endanger the client's health or safety;
- the client has failed to disclose relevant medical information;
- the client is under the influence of alcohol or recreational drugs;
- the client behaves in a threatening, abusive, violent or inappropriate manner towards staff or other clients;
- the client repeatedly fails to comply with treatment instructions;
- the client repeatedly misses scheduled appointments;
- payment obligations remain outstanding; or
- continuing treatment would otherwise be inconsistent with professional standards or applicable law.
Where treatment is refused or discontinued under this clause, any refund shall be determined in accordance with this Policy.
26. Force Majeure
The Clinic shall not be liable for any delay, cancellation or inability to perform its obligations where such delay or failure results from events beyond its reasonable control, including but not limited to:
- acts of God;
- epidemics or pandemics;
- fire;
- flood;
- civil unrest;
- industrial action;
- government directives;
- power outages;
- telecommunications failures;
- equipment failure despite reasonable maintenance; or
- any other unforeseen event beyond the reasonable control of the Clinic.
Where reasonably practicable, affected appointments shall be rescheduled.
27. Severability
If any provision of this Policy is determined by a court or other competent authority to be invalid, illegal or unenforceable, the remaining provisions shall continue in full force and effect.
The invalid provision shall, where possible, be interpreted in a manner that most closely reflects the original commercial intention of the parties.
28. Waiver
Failure by the Clinic to enforce any provision of this Policy at any time shall not constitute a waiver of that provision or of any other provision.
No waiver shall be effective unless made in writing and signed by an authorised representative of the Clinic.
29. Entire Agreement
This Policy, together with any treatment consent forms, treatment plans, quotations, invoices and any other documents expressly incorporated by reference, constitutes the entire agreement between the client and the Clinic regarding the services provided.
It supersedes all prior discussions, representations, understandings or agreements relating to the subject matter.
30. Policy Amendments
25PSKYN Studios reserves the right to amend or update this Policy from time to time to reflect changes in:
- applicable laws and regulations;
- clinical standards and best practices;
- operational requirements;
- business processes; or
- treatment protocols.
Any amendments shall take effect from the date specified by the Clinic and shall apply prospectively unless otherwise required by law.
Clients who continue to receive services after an amendment takes effect shall be deemed to have accepted the revised Policy.
31. Governing Law and Dispute Resolution
This Policy shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
The parties shall first seek to resolve any dispute arising under this Policy amicably through good-faith discussions.
If the dispute cannot be resolved within thirty (30) days, the parties may refer the dispute to mediation before commencing court proceedings.
Nothing in this clause shall prevent either party from seeking urgent injunctive or interim relief from a court of competent jurisdiction where necessary.
32. Complaints
25PSKYN Studios is committed to delivering high standards of service.
Clients who are dissatisfied with any aspect of the services provided should notify the Clinic as soon as reasonably practicable.
Complaints should be submitted in writing and include:
- the client's full name;
- date of treatment;
- description of the complaint;
- supporting documentation where available.
The Clinic shall investigate complaints fairly and communicate its findings within a reasonable period.
33. Client Declaration and Acknowledgement
I hereby acknowledge and confirm that:
- I have carefully read and understood this Treatment Plan, Payment, Refund & Client Consent Policy.
- I have had the opportunity to ask questions regarding this Policy and have received satisfactory answers.
- I understand the difference between paying for treatment on a per-session basis and purchasing a discounted Treatment Plan.
- I understand that Treatment Plans are discounted promotional packages and not simply prepaid treatment sessions.
- I understand that the Consultation Fee is non-refundable once the consultation has been completed.
- I understand that Included Products form part of the value of my Treatment Plan and are not complimentary gifts.
- I understand that if I request a refund, the cost of Included Products, Consultation Fees, VAT and any other applicable deductions may be deducted in accordance with this Policy.
- I understand that refund calculations are based on unused treatment sessions and not on the total amount paid for the Treatment Plan.
- I understand that the same refund principles apply whether I request a partial refund or a full refund before or after treatment has commenced.
- I understand that treatment outcomes cannot be guaranteed.
- I consent to receiving treatment from 25PSKYN Studios.
- I consent to the collection and processing of my personal information in accordance with the Nigeria Data Protection Act, 2023.
- I authorise the Clinic to process payments and any approved refunds in accordance with this Policy.
- I agree to be bound by this Policy.
